WEDDING PHOTOGRAPHY
TERMS & CONDITIONS

This agreement contains the entire understanding between Michael Weinberg Photography and the CLIENT. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties.

RESERVATION:
A reservation fee (agreed upon deposit) is required to reserve the specified coverage.  Michael Weinberg Photography accepts all major credit cards, debit cards, and cash transfers through PAYPAL. We also gladly accept money orders or your personal check.

CONTRACT:
Michael Weinberg provides a written contract containing "Wedding Photography Terms and Conditions" and a detailed description of the CLIENT's costs and the photographic services to be performed. The contract is to be delivered and signed on or before the date of the wedding.

PRE-WEDDING CONSULTATION:
The parties agree to a pre-event consultation before the wedding in order to plan and finalize the actual shooting times, locations, and CLIENT'S requests for specific photographs. This consultation may occur from one to four weeks before the wedding (preferred) or can be held on the date of the wedding itself. When the consultation is held on the date of the wedding, the meeting ought to take place at a minimum of one hour (60 minutes) before the first required photographs of the bride and/or the groom.

COOPERATION:
The parties agree to cheerful cooperation and communication for the best possible results and that Michael Weinberg Photography will make a reasonable, good faith attempt to capture all the required photographs during the event. Though not required, Michael Weinberg Photography recommends that the CLIENT designate an "event guide"  (someone close to the bride or groom) who will point out important individuals, for informal or candid photographs, to the photographer during the wedding reception. 

HOUSE RULES:
The CLIENT understands that some photos may not be possible to attain because of the rules imposed by the ceremony official ( priest, rabbi, minister, officiate, etc.).

DIGITAL IMAGES and COPYRIGHTS:
The images, digital or paper, produced by Michael Weinberg Photography are protected by Federal Copyright Law (all rights reserved). Upon final payment by the CLIENT, limited copyright ownership of the purchased images will be transferred to the CLIENT under the following conditions: The Prints, Reprints, Albums, Posters and Digital Images are the property of CLIENT for personal use and may be reproduced for friends and relatives. The Client, however, must obtain written permission from Michael Weinberg if the choose to sell any Michael Weinberg Photography images for profit.

The CLIENT grants Michael Weinberg Photography permission to display images, including images where the client is included for advertising purposes, as an example of Michael Weinberg’s Photography work . The client releases all claims to profits and liabilities that may arise from use of these images.

In the unlikely event that Michael Weinberg is injured or becomes too ill to photograph the event, Michael Weinberg Photography will make every effort to secure a replacement photograp
her. If this situation should occur and a suitable replacement can not be found, responsibility and liability is limited to the return of all payments received for the event. Also, in the unlikely event that some or all digital photograph files from the event are lost, stolen, or destroyed for reasons beyond Michael Weinberg Photography's control, Michael Weinberg Photography's liability is  based on the percentage of images that are lost. 

FEES AND SECURITY DEPOSITS:
An agreed upon deposit, usually 1/3 of the photography fee agreed to (including applicable sales tax), is required to reserve the wedding date. The remaining balance is to be paid on or before the date of the wedding. Fees and security deposits can be made using all major credit cards, check, money order or cash transfer using PAYPAL. Any additional expenses, travel expenses, additional time, special services, etc., must also be paid prior to receiving proofs, accessing online proofs, photos or albums included in the package.  In the event of cancellation by the CLIENT, the security deposit paid is non-refundable.

TRAVEL AND MISCELLANEOUS EXPENSES:
The CLIENT is responsible for travel expenses as outlined int the chart below:

Pennsylvania Digital Photographer Specializing in professional portrait, landscape, wedding, aerial, bar mitzvah, bat mitzvah, fashion, commerical architectural, fine art, floral and journalistic photography. The goal: to create long-lasting vivid and colorful memories, captured photographically for people coming together, from far and near, to celebrate a truly special event. Located in Clarks Summit, Lackawanna County Pennsylvania, I travel all over the continental United States capturing images, both for business and for pleasure. Many of my business and commercial images are used in the graphic design of advertising brochures for industry, retail, wholesale and non-profit organizations and establishments. I use mainly Canon Digital cameras, EOS 300D and the new Canon 20D, but I use a variety of lenses from diferent manufacturers including Sigma and Tamron. Ny favorite lenses are the Tamron sp af 28-75mm f2.8 xr di ld asph, and the canon ef 50mm f/1.4 usm. Also I use a wide variety of circular UV and polarizing filters with much of my work, especially when doing landscapes and architectural photography when the sun is out burning bright. On the photo editing end, my main work horse is Adobe Photoshop 8.0 as part of the Adobe CS Suite of publishing tools. I have become particularly fond of the new shadow/highlight tool which helps me to reveal objects that appeared to be in totally dark areas. In the photo above, I used the shadow / highlight tool to reveal the light spaces on the front porch. This tool is also quite useful in producing and composing portrait work when the main subject does not contrast well with a dark background. Use of the shadow / highlight tool in conjunction with the fade tool in the edit menu is a powerful way to tweak photos into perfection. It allows the photographer to have perfect exposure. And of course, we should not forget the hue / saturation tool which can act as a polarizing filter. I especially like to use the hue saturation tool when editing photos taken with slow shutter speed and small apertures f/11 thru f/22. The greatest thing a critic can say to me about my work is not that it is spot on, not that the exposure was perfect or the focus extremely sharp, not that the compositoin was flawless or that my work adhered to the rule of thirds, but that the photo made them smile or made them feel good....that they liked the colors and it made their eyes to pop. now you can find from time to time on photosig or pbase, or sometimes you will see perusing through the new york times or the wall street journal or the washington post.
